Terms of Website Use

These terms of use have been created by Lee Frost Photography and Photo Adventures for the information of visitors to this website (www.leefrost.co.uk) and form the conditions which govern use of this website. Use of this site includes accessing and browsing our site or services. Please read these terms carefully before using this site; by using this site, you confirm you have accepted these terms of use and that you agree to comply with them.

Intellectual Property Rights; Authorised & Unauthorised Use of Images & Content

All images and text contained on this website remain the property of Lee Frost Photography and is protected by United Kingdom and international copyright laws. Content may not be downloaded, reproduced, copied, projected, or used in any way without express written permission. Various tracking systems may be in place at any time to identify unauthorised use. Unauthorised users agree that they will be liable for a standard £100.00 administration charge per image, plus an appropriate reproduction fee, at the sole discretion of Lee Frost Photography Ltd.

Website Orders & Payments

When you place an order on our website, we will e-mail you to acknowledge receipt of your order and payment.

Payment Methods

All payments on this website are processed automatically via Stripe. Stripe offers an industry standard secure on-line payments system. You can use any credit or debit card to pay via Stripe and can even make payments if you do not have an account. Bank transfer (BACS) can also be accepted as a method of payment. Please contact us if you would like to pay using this method.

BOOKING WORKSHOPS AND TOURS - TERMS AND CONDITIONS

Booking & Payment

To confirm a workshop booking you are required to pay either a non-refundable deposit, or you have the option to pay in full when you place your order. We will email you to acknowledge your order and payment. An invoice will be sent to request the balance up to 60 days before the workshop commencement date.  If payment is not received by the specified date, we reserve the right to treat the booking as cancelled and retain the deposit.

Receipt of a deposit does not imply acceptance of the booking. We will confirm acceptance of your booking by email and it is at the time we send out this confirmation that a contract comes into existence between us.

Cancellation of Booking

If you wish to cancel a workshop booking you must advise us by email. The date on which the email is received will determine the cancellation charges that are applicable. Those charges are expressed as a percentage of the total workshop price, as follows: More than 60 days before departure – loss of deposit; 60-40 days before departure – 50%; 40-30 before departure - 75%; less than 30 days before departure - 100%.

Changes to Workshops

We reserve the right to make changes to the workshop advertised. If cancellation is due to circumstances beyond our control (e.g. fire, flood, industrial disputes, bereavement, etc.) we may give less than 30 days notice. Should this unlikely event occur, we will contact you to advise you of the workshop changes, and give you the option of accepting or rejecting the change. If you choose to reject, we will offer you a full refund of your payment (including deposit) for the workshop, or you can transfer any payments already made to an alternative Photo Adventures Workshop.

Workshop Cancellations by Lee Frost Photography/Photo Adventures

We reserve the right to cancel any workshop and should this happen, we will contact you as soon as is reasonably possible. Upon cancellation, we will offer you a full refund of your payment (including deposit) for the workshop, or you can transfer any payments already made to an alternative Lee Frost Photography/Photo Adventures Workshop or tour.

For the avoidance of doubt, as Lee Frost Photography/Photo Adventures is not party to any flight bookings you make yourself and has received no payment for the same, we will not refund the cost of your flight in the event of a workshop or tour being cancelled. Your attention is drawn to the clause below titled Insurance.

In the event of the specified tour leader being unable to attend due to illness or other circumstances beyond our control, another tour leader will be appointed. If this is not possible, the tour will be cancelled as per the terms and conditions stated above.

Lee Frost Photography/Photo Adventures reserves the right to change any of the prices, details, services or other particulars of a workshop or tour before entering into a contract with you. If there are any changes, we will notify you before entering into the contract,

Underbooking is the situation in which the minimum number of bookings required to run a tour is not met, and if we have to cancel a tour because of this we will not do so less than 30 days prior to departure.

In the event of force majeure occurring before the departure date of a workshop or tour, or during a workshop or tour, no refund shall be payable to the client. Force majeure is unusual and unforeseeable circumstances out of our control, such as war, the threat of war, terrorist activity, riots, civil unrest, industrial disputes, natural or nuclear disaster, fire, flood or adverse weather.

Liability

All workshop/tour participants entering into a contract with Lee Frost Photography/Photo Adventures do so at their own risk and Lee Frost photography/Photo Adventures accepts no liability or responsibility for death, injury or damage done to their persons or property while participating in a workshop or tour. It is recommended that participants hold their own personal Public Liability Insurance and it is also essential to take out suitable travel insurance before embarking on any workshops or tours with Lee Frost Photography/Photo Adventures.

By booking with Lee Frost Photography/Photo Adventures, you acknowledge that there is always an element of risk in any outdoor photography workshop or tour. You must be physically fit and capable of participating in the workshop or tour on which you have booked and are fully and completely aware of any associated risks created by field locations and weather.

The type of workshops and tours we offer require flexibility and you must allow for alternatives. For this reason, the outline itinerary and the workshop/tour description must be taken as an indication of what may take place on the workshop/tour, and not as a contractual obligation on the part of Lee Frost Photography/Photo Adventures.

By booking with Lee Frost Photography/Photo Adventures, you acknowledge that you have read these terms and conditions and understand your responsibilities and obligations as well as the relevant workshop/tour specifications (including that you need to be physically fit in order to take part in the relevant workshop) and release Lee Frost Photography/Photo Adventures from any liability.

Travel

Where airport/hotel transfers are included in the cost of a holiday, such transfers are only included when participants travel on the flights specified by Lee Frost Photography/Photo Adventures. Participants arriving or departing on different flights will be responsible for their own transfer costs and arrangements.

Flight booking is the client’s responsibility and Lee Frost Photography/Photo Adventures is not responsible for any expenses, loss or other damage caused to you by the acts or omissions of the carrier.

You shall ensure that you arrive on time at the specified airport/port/departure point for the relevant workshop or tour and on the specified date. Lee Frost Photography/Photo Adventures cannot be held responsible or liable for lack of punctuality, delayed or cancelled flights for any reason, or any problem in transit. Lee Frost Photography/Photo Adventures does not accept liability for any loss or additional expense caused by delay or interruption to travel service which impact upon your ability to arrive for the relevant workshop or tour on the specified date or time for any reason other than the gross negligence of Lee Frost Photography/Photo Adventures. Such losses or additional expenses shall be the responsibility of you.

You must be in possession of a valid passport and all visas, permits and certificates including medical certificates required for the whole of the journey and you accept responsibility for obtaining the same. All information and advice given by us on visas, vaccinations, climate, clothing, baggage and special equipment is given in good faith.

In the unlikely event that we become unable to provide a significant proportion of the services you have booked after you depart, we will make alternative arrangements for you at no extra charge, or if this is impossible we will provide you with transport back to the point of departure from your holiday destination and a pro-rata refund for the cost of the remainder of your holiday. In addition, if appropriate, we will pay you compensation of an amount which is reasonable taking into account the circumstances, and which is not covered by the terms and conditions of your own travel insurance.

Insurance

It is a term of the contract between Lee Frost Photography/Photo Adventures and you, the client, that you will obtain the appropriate travel insurance cover before you set out on the workshop or tour (whether in the United Kingdom or any other country). The insurance must cover the loss, expenses and damages arising from, including but not limited to, the cancellation of the holiday (whether whole or in part), personal accident and injury, medical and repatriation costs, loss of baggage and personal money, and belongings and flight cancellations and delays.

Any item of equipment (photographic or otherwise) loaned by Lee Frost Photography/Photo Adventures (or any co-leader on the workshop or tour) to you during the course of the workshop or tour, will be the personal responsibility of you, and any loss or damage must be paid for by you.

Dispute

You must communicate any perceived failure in the performance of this contract on the spot to the tour leader representing Lee Frost Photography/Photo Adventures, thus giving the tour leader the opportunity to achieve a satisfactory solution. Should this not be possible, you should make your complaint known to us in writing within 30 days of the completion of the holiday.

All Contracts made between Lee Frost Photography/Photo Adventures and you shall be governed by the Laws of England. You accept that the total liability to you on any matter whatsoever relating to the Contract or on any consequential loss relating to the Contract cannot exceed the total Contract price.

Any dispute arising from the Contract must be confirmed by you in writing within 30 days. In the first instance you agree that you and we shall try to reach an amicable settlement via agreement or mediation; if these fail the dispute shall be subject to the exclusive jurisdiction of the English courts.

Binding agreement

By completing and sending the booking for you are agreeing to accept all of the above conditions for yourself and as authorised agent for any other individuals names thereon, such that all are deemed to be fully aware of, bound by, the same booking terms and conditions.
